Penalty for failing to file P46 online
It has come to our attention that one of our clients has received a penalty notice from HMRC for failing to submit an online P46 form for an employee leaving the company.
This is the first penalty notice we have seen relating to the submission of payroll documentation, but clearly demonstrates HMRC’s intention to take a tough line for those companies failing to comply with their online filing rules.
From 6 April 2011, HMRC changed the method by which they will receive information relating to new starters and leavers and since this date, employers with fewer than 50 employees have had to file all starter and leaver forms online.
This particular client handled their payroll in-house at the time this error occurred, however since outsourcing their payroll to Prime, they now have confidence that all forms are filed online.
We would encourage all businesses where they handle their own payroll, to pay particular attention to the online filing rules to ensure they do not penalised unnecessarily.
