Payroll for Construction Companies

Under changes introduced on 6th April 2007 all construction companies are required to abide by new legal requirements for payroll.   The new Construction Industry Scheme (CIS) requires all construction firms, large and small, to follow certain rules in relation to their use of sub-contractors.

All contractors are required to take the following actions:

  • Check the status of existing sub contractors – to establish whether they should be treated as employees or self employed sub contractors
  • Check any new subcontractors taken on in the month
  • Process pay accordingly
  • Provide all sub contractors with a detailed monthly ‘payslip’ which makes it clear that they are not employees
  • Prepare a monthly declaration by the 19th of each month and pay over all deductions made from subcontractors
    The onus is on the contractor and of course there are penalties for failing to file returns correctly.
